The Port Antigua at Coral Bay Village Association (also referred to as Port Antigua or as the HOA) is one of the 8 HOA’s within the Coral Bay Community Development District (also referred to as the District or the CDD). The CDD encompasses approximately 236 acres and is located in the City of Margate Florida, just to the south of Sample Road (SR 834) and to the west of N State Road 7 / 441. The CDD owns, operates, and maintains approximately 71 acres of water management tracts, including a 69-acre lake.
Specifically, the Port Antigua HOA consists of 147 individual parcels with a home on each.
The HOA is overseen by a Board of Directors, that is defined as no more than 5 and no less than 3 members, that are majority resident-owners and are elected / reappointed annually at a special annual meeting of the HOA members. The Board is supported by a professional HOA management company that provides day-to-day management of the HOA. The HOA Board normally meets on the first Tuesday of each month at a time and method designated at the top of the left sidebar of this web site under “NEXT MEETING”.
It is important to understand the scope of responsibilities of the HOA, and its relationship to the CDD. The limits of an HOA’s responsibilities are essentially set when the developer establishes the property ownership, and therefore maintenance responsibility, of the various components of the community. Some developers, particularly with large communities, place ownership of the common areas (pools, parks, roads, etc.) with each HOA within the development; others place that ownership with some kind of “master” or overall association.
In the case of Coral Bay, the developer placed the ownership and responsibility of all common areas with the CDD, and placed ownership of each parcel of land, and the home on it, with the respective homeowner. Therefore, none of the HOAs within Coral Bay, including Port Antigua, own any common property, and therefore all maintenance, and any issues dealing with common areas such as the roads, on-street parking, the gates, the parks, the pools, the lake, and canals, are outside of the scope of the Port Antigua HOA’s responsibility, and should be addressed to the CDD and its management company. This means that the primary responsibility of the HOA Board, with support from the HOA management company, is to enforce the HOA’s governing documents, and thus maintain a quality living environment that protects the property values of all owners. Those governing documents address the aesthetic and architectural appearance of our community, as well as the responsibilities of the Board.
Since the HOA’s responsibility is limited in scope and the maintenance and associated management of all common elements is the responsibility of the CDD, the bulk of the expenses reside with the CDD as well. Since the HOA maintenance fee is relatively small, the HOA collects its maintenance fee annually in order to minimize the time and expense of what is monthly collection processing in other communities with a different structure. As an FYI, the CDD fees, that are actually a non ad valorum tax, are also collected annually as they are collected as part of the Broward County tax bill payment.
Please note that to fulfill the main responsibilities in the HOA’s governing documents, all exterior changes to your property require the approval of the Board, even if you are replacing something exactly as it was (including paint colors). You MUST obtain and submit an appropriate ARC change request form, with appropriate attachments, and receive approval BEFORE making the change. Failure to do so will result in violations, fines, and, depending on the problem, the work may be subject to removal / reversal at the owner’s expense!
